Everything you need to know about how Fuel with Jess operates, protects your information, and what to expect when you work with me.

Please read these Terms & Conditions carefully before using the Fuel with Jess website or engaging our coaching services. By accessing or purchasing services, you agree to be bound by these terms. If you do not agree, please do not use the site or services.

1. About Us

Fuel with Jess is a health coaching business operated by Jessica Pierce in California. We provide nutrition education, macro coaching, meal planning guidance, and lifestyle support. Coach is certified and is not a licensed physician, registered dietitian (RDN), or other licensed healthcare provider.

2. Acceptance of Terms

By using this site or engaging our services, you confirm that you are at least 18 years of age, legally capable of entering into agreements, and have read and understood these Terms.

3. Services

Services are offered as described on this website and in your Coaching Services Agreement. Fuel with Jess reserves the right to modify, suspend, or discontinue any service at any time with reasonable notice.

4. Not Medical Advice

All information provided through this site and through coaching services is for general educational purposes only and does not constitute medical advice, diagnosis, or treatment. It is not a substitute for professional medical advice. Always consult a qualified healthcare provider before making significant dietary changes, especially if you are pregnant, nursing, or have a pre-existing medical condition.

5. User Responsibilities

  • Provide complete and accurate information about your health and goals
  • Notify Coach promptly of any changes to your health status
  • Use all content and resources for personal, non-commercial purposes only
  • Do not share, distribute, or reproduce proprietary materials without prior written consent

6. Intellectual Property

All content on this site including text, graphics, logos, guides, and trademarks is the property of Fuel with Jess Health Coaching, LLC. You may not create derivative works or use any content commercially without prior written consent.

7. Testimonials & Results Disclaimer

Client stories and testimonials reflect individual experiences and are not a guarantee of results. Outcomes vary based on effort, adherence, body composition, and other individual factors.

8. Third-Party Links

This site may contain links to third-party sites (e.g., Amazon affiliate links, booking tools) for convenience. These links do not imply endorsement. Fuel with Jess is not responsible for third-party content or privacy practices.

9. Limitation of Liability

To the fullest extent permitted by law, Fuel with Jess shall not be liable for any indirect, incidental, consequential, or punitive damages. Total liability shall not exceed the total amount paid by the client in the three months preceding the claim.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California. Disputes will first be attempted to be resolved through good-faith negotiation. If unresolved, disputes will be submitted to binding arbitration in the applicable California county.

This Privacy Policy describes how Fuel with Jess Health Coaching, LLC ("we," "us," or "our"), operated by Jessica Pierce, collects, uses, stores, and protects personal information provided by visitors to our website and clients who engage in coaching services. By using our services, you agree to the terms of this Policy.

1. Information We Collect

Information You Provide Directly:

  • Contact info: name, email address, phone number
  • Health & wellness info: age, height, weight, medical conditions, dietary restrictions, food preferences
  • Lifestyle info: sleep habits, activity levels, exercise routine, occupation, alcohol/tobacco use, prior macro tracking experience
  • Payment info: processed through third-party payment processors; we do not store credit card data directly
  • Communications: messages, session notes, and exchanges between coach and client

Information Collected Automatically: Page visit data, time spent on site, browser type, general location, and cookies or similar tracking technologies.

2. How We Use Your Information

  • To deliver and improve coaching services
  • To send program updates and session reminders
  • To create personalized meal plans and macro targets
  • To comply with legal obligations
  • To send periodic email communications (you may opt out at any time)

We will never sell, rent, or share your personal information with third parties for marketing purposes without your explicit consent.

3. Sensitive Health Information

We understand that health information is sensitive. All data including body metrics, medical history, and coaching notes is stored securely and accessible only to authorized team members. It is used solely to deliver and improve your coaching experience.

4. Data Sharing

We may share data with service providers who help us operate (e.g., Google Calendar, Formspree, Instagram) only as long as necessary to deliver services. We do not sell personal data. We may disclose information if required by law.

5. Data Retention

Client records are retained for a minimum of three (3) years unless a longer retention period applies. Upon request, records may be deleted subject to certain legal exceptions.

6. Your Rights (California Residents)

Under the California Consumer Privacy Act (CCPA), you have the right to:

  • Know what personal data we collect and how it is used
  • Request deletion of your personal data
  • Opt out of any data sale (we do not sell data)
  • Non-discrimination for exercising your privacy rights

7. Data Security

We take reasonable organizational and technical measures to protect your data from unauthorized access or loss, including password protection and encryption where available. No method of internet transmission is 100% secure, however, and we cannot guarantee absolute security.

8. Cookies

We may use cookies and similar technologies to analyze traffic and improve site functionality. You can disable cookies in your browser settings, though some features may not function properly as a result.

9. Children

Our services are intended for individuals 18 and older. We do not knowingly collect data from minors. If you believe a minor has provided us information, please contact us immediately.

10. Changes to This Policy

We may update this Privacy Policy periodically. Continued use of our services after changes constitutes acceptance of the updated policy.

1. Parties

This Agreement is between Jessica S. Pierce ("Coach"), operating as Fuel with Jess Health Coaching, LLC, a California limited liability company, and the client identified by signature.

2. Scope of Services

Services include personalized macro and calorie target setting, meal planning guidance, nutrition label and serving size education, regular check-ins, accountability support, and recommended resources. Services do not constitute medical treatment, therapy, clinical nutrition management, or diagnosis.

3. Fees & Cancellation

All fees are due in advance. Clients may cancel with 30 days' written notice. A full refund minus a $20 administrative fee is issued for cancellations before the program begins. After the program starts, prorated refunds for uncompleted sessions may be issued at Coach's sole discretion.

4. Client Responsibilities

  • Provide accurate health and lifestyle information
  • Notify Coach of any health status changes
  • Continue working with a physician for medical concerns
  • Take responsibility for personal dietary and lifestyle decisions
  • Keep shared information confidential

5. Photo & Testimonial Release

Clients may choose to authorize or decline use of their progress information or testimonials for marketing purposes. This is confirmed in the signed agreement.

6. Limitation of Liability

Coach's liability is limited to fees paid in the three months prior to any claim. Coach is not liable for indirect or consequential damages.

7. Not Medical Advice

Coach is a certified nutrition coach, not a licensed physician or registered dietitian. Clients are encouraged to consult a healthcare provider before making significant dietary changes.

1. Parties

This Waiver is between Jessica S. Pierce ("Coach"), operating as Fuel with Jess Health Coaching, LLC, and the client identified by signature.

2. Physician Consultation Required

Clients agree to consult their physician before beginning any program, particularly if they have a pre-existing medical condition, are pregnant or nursing, are taking prescription medications, have a history of disordered eating, or have had recent surgery.

3. Assumption of Risk

Nutrition coaching involves voluntary dietary and lifestyle changes that carry inherent risks. Client voluntarily participates and assumes full responsibility for any adverse reactions or outcomes. Results are not guaranteed.

4. Release of Liability

Client releases Coach and affiliated parties from claims arising from physical harm, failure to achieve results, or errors in connection with services.

5. Eating Disorders & Special Populations

Clients with a known or suspected eating disorder must obtain written clearance from a licensed healthcare provider before beginning services. Coach reserves the right to decline or discontinue services outside the scope of nutrition coaching practice.

IMPORTANT: If you are currently being treated for an eating disorder or condition defined under California Business & Professions Code §2700 et seq., Coach is not qualified to provide clinical dietary management and will refer you to appropriate licensed professionals.

6. Indemnification

Client agrees to indemnify and hold harmless Coach from any claims, damages, or expenses arising from client's use of services or breach of this Waiver.
